Mir\u00ebpo, n\u00eb rastin konkret t\u00eb fertilizimit t\u00eb asistuar dhe shtatz\u00ebnis\u00eb surrogate, shtrohet pyetja: si e respekton kjo praktik\u00eb dinjitetin njer\u00ebzor t\u00eb f\u00ebmij\u00ebs e t\u00eb gruas? Nisur nga fakti q\u00eb ky projektligj synon t&#8217;i ligj\u00ebsoj\u00eb k\u00ebto praktika, kuptojm\u00eb se interpretimi q\u00eb i jepet konceptit &#8220;dinjitet njer\u00ebzor&#8221; n\u00ebp\u00ebrmbajtjen e vet, \u00ebsht\u00eb i till\u00eb: \u00ebsht\u00eb n\u00eb p\u00ebrputhje me dinjitetin njer\u00ebzor q\u00eb d\u00ebshira p\u00ebr t\u00eb pasur f\u00ebmij\u00eb t\u00eb njihet si nj\u00eb e drejt\u00eb q\u00eb duhet mbrojtur me ligj. Dinjiteti njer\u00ebzor, i kuptuar k\u00ebshtu, i hap rrug\u00ebn praktikave e teknikave q\u00eb, n\u00eb m\u00ebnyr\u00eb kontradiktore, nd\u00ebrsa duket se i respektojn\u00eb t\u00eb drejtat njer\u00ebzore, mohojn\u00eb vet\u00eb qenien njer\u00ebzore, q\u00eb n\u00eb shfaqjen e par\u00eb t\u00eb saj. Kjo gj\u00eb b\u00ebhet e qart\u00eb kur shohim rrug\u00ebn q\u00eb ndiqet p\u00ebr t\u00eb arritur te am\u00ebsia surrogate.<\/p>\n<p>Praktika nis me diagnostikimin para implantimit &#8211; DPI &#8211; (neni 24, pika 1), si pjes\u00eb e procesit t\u00eb riprodhimit t\u00eb asistuar in vitro, q\u00eb ka p\u00ebr q\u00ebllim riprodhimin pas nj\u00eb selektimi gjenetik, q\u00eb sh\u00ebrben p\u00ebr t\u00eb rritur p\u00ebrqindjen e suksesit t\u00eb shtatz\u00ebnis\u00eb. N\u00eb k\u00ebt\u00eb rast, nuk b\u00ebhet fjal\u00eb p\u00ebr sh\u00ebndetin gjenetik, por p\u00ebr suksesin e shtatz\u00ebnis\u00eb. Kjo praktik\u00eb nuk mund t\u00eb mb\u00ebshtetet nga pik\u00ebpamja etike, sepse riprodhon duke seleksionuar, e p\u00ebr pasoj\u00eb skarton embrionet q\u00eb, si qenie njer\u00ebzore prej momentit t\u00eb ngjizjes (krh. P\u00ebrkufizimet, neni 3, pika 1, shkronja d), kan\u00eb t\u00eb drejt\u00eb t\u00eb jetojn\u00eb. K\u00ebsisoj, ajo krijon q\u00ebllimisht nj\u00eb situat\u00eb t\u00eb v\u00ebshtir\u00eb, ku d\u00ebshira p\u00ebr t\u00eb pasur f\u00ebmij\u00eb shoq\u00ebrohet me refuzimin k\u00ebtij t\u00eb fundit, gj\u00eb kjo q\u00eb p\u00ebrb\u00ebn nj\u00eb kontradikt\u00eb t\u00eb mir\u00ebfillt\u00eb. Sa i p\u00ebrket, ngrirjes s\u00eb embrioneve t\u00eb &#8216;tep\u00ebrta&#8217;, nuk ka asnj\u00eb rrug\u00ebdalje moralisht t\u00eb lejueshme.<\/p>\n<p>Teknikat e riprodhimit mjek\u00ebsor t\u00eb asistuar, p\u00ebrve\u00e7 mosrespektimit dhe mbrojtjes s\u00eb jet\u00ebs, paraqesin edhe dy problematika kryesore: ndajn\u00eb aspektin bashkues nga ai riprodhues dhe \u00e7ka ia shton edhe m\u00eb shum\u00eb pesh\u00ebn morale, ndajn\u00eb riprodhimin nga uniteti i martes\u00ebs, sikurse ndodh me fertilizimin dhe inseminimin heterolog.<\/p>\n<p>D\u00ebshira p\u00ebr t\u00eb pasur f\u00ebmij\u00eb \u00ebsht\u00eb natyrore dhe legjitime, por nuk mund t\u00eb vihet para dinjitetit t\u00eb \u00e7do jete njer\u00ebzore. F\u00ebmija nuk \u00ebsht\u00eb objekt, q\u00eb mund t\u00eb porositet, blihet e pron\u00ebsohet si person-dhurat\u00eb. N\u00eb k\u00ebt\u00eb k\u00ebndv\u00ebshtrim, pretendimi i s\u00eb drejt\u00ebs p\u00ebr t\u00eb pasur f\u00ebmij\u00eb, mohon pik\u00ebrisht t\u00eb drejt\u00ebn e tij p\u00ebr t&#8217;u respektuar n\u00eb dinjitetin e vet.<\/p>\n<p>Do t\u00eb ishte e udh\u00ebs, nga ana tjet\u00ebr, t\u00eb flitej p\u00ebr t\u00eb drejt\u00ebn e f\u00ebmij\u00ebs: t\u00eb drejt\u00ebn e tij q\u00eb t\u00eb lind\u00eb si fryt i dashuris\u00eb; t\u00eb drejt\u00ebn e sh\u00ebndetit, dometh\u00ebn\u00eb q\u00eb teknikat e fekondimit artificial t\u00eb mos p\u00ebrdoren p\u00ebr q\u00ebllim selektiv (krahaso neni 24, pika 1, a); t\u00eb drejt\u00ebn q\u00eb t\u00eb njoh\u00eb origjin\u00ebn e prind\u00ebrve t\u00eb vet biologjik\u00eb, edhe pse kjo gj\u00eb hyn n\u00eb konflikt me t\u00eb drejt\u00ebn e privat\u00ebsis\u00eb dhe konfidencialitetit (krahaso neni 4, pika 1, c); t\u00eb drejt\u00ebn p\u00ebr t\u00eb dy prind\u00ebrit dhe familje, gj\u00eb q\u00eb kund\u00ebrshton t\u00eb drejt\u00ebn q\u00eb p\u00ebrdoruesi i k\u00ebtyre teknikave t\u00eb jet\u00eb gruaja pa partner (kreu IV, neni 15, pika 3). N\u00eb rastin e fundit, mohohet r\u00ebnd\u00ebsia e figur\u00ebs s\u00eb babait dhe rolit t\u00eb familjes. Pohohet nevoja p\u00ebr dhuruesin mashkull, por jo p\u00ebr prindin baba.<\/p>\n<p>Nj\u00eb aspekt shum\u00eb i r\u00ebnd\u00ebsish\u00ebm \u00ebsht\u00eb impakti afektiv dhe kriza e identitetit, q\u00eb shkakton te f\u00ebmija surrogacia.<\/p>\n<p>&#8220;N\u00ebna surrogate&#8221;, bie ndesh me dinjitetin themelor t\u00eb \u00e7do qenieje dhe t\u00eb drejt\u00ebn e saj p\u00ebr t&#8217;u njohur gjithmon\u00eb p\u00ebr at\u00eb q\u00eb \u00ebsht\u00eb n\u00eb vetvete dhe kurr\u00eb si mjet p\u00ebr nj\u00eb tjet\u00ebr. A mund t\u00eb p\u00ebrdoret nj\u00eb person (n\u00ebna surrogate) si mjet p\u00ebr sh\u00ebndetin seksual e riprodhues t\u00eb nj\u00eb personi tjet\u00ebr? A nuk kan\u00eb t\u00eb gjith\u00eb njer\u00ebzit t\u00eb drejta t\u00eb barabarta? K\u00ebto t\u00eb drejta mohohen haptazi, n\u00eb kund\u00ebrshtim edhe me Deklarat\u00ebn Universale mbi t\u00eb Drejtat e Njeriut, ku pohohet se: \u00abT\u00eb gjith\u00eb njer\u00ebzit lindin t\u00eb lir\u00eb dhe t\u00eb barabart\u00eb n\u00eb dinjitet dhe n\u00eb t\u00eb drejta\u00bb (Neni 1).<\/p>\n<p>Dimensioni personal e social i sh\u00ebndetit seksual e riprodhues<\/p>\n<p>Sh\u00ebndeti seksual (krahaso Neni 3, pika 1,) nuk mund t\u00eb reduktohet n\u00eb sfer\u00ebn fizike t\u00eb struktur\u00ebs gjenitale, e as n\u00eb aspektet m\u00eb intime t\u00eb jet\u00ebs personale. Njeriu \u00ebsht\u00eb i thirrur p\u00ebr n\u00eb dashuri si shpirt i mish\u00ebruar, pra shpirt dhe trup n\u00eb unitetin e personit. Nga kjo pik\u00ebpamje, projektligji, sado q\u00eb flet p\u00ebr sh\u00ebndetin riprodhues, duke e lidhur me mir\u00ebqenien fizike, mendore dhe sociale, n\u00eb realitet e zhvesh at\u00eb plot\u00ebsisht nga konteksti personal e social: mitr\u00ebn mund ta jap\u00ebsh me qira, mund t&#8217;ia d\u00ebmtosh asaj p\u00ebrgjithmon\u00eb funksionin, mund t\u00eb p\u00ebrdoret trupi n\u00eb marr\u00ebdh\u00ebnie seksuale pa angazhim personal, mund t\u00eb shes\u00ebsh qelizat riprodhuese etj. T\u00eb gjitha k\u00ebto futen n\u00ebn \u00e7adr\u00ebn e sh\u00ebndetit seksual e riprodhues me justifikimin se individi ka t\u00eb drejt\u00ebn e vet\u00ebp\u00ebrcaktimit, sikur efektet e veprimeve t\u00eb tij t\u00eb ngeleshin t\u00eb izoluara vet\u00ebm n\u00eb sfer\u00ebn private, kur n\u00eb fakt, nuk ekziston asnj\u00eb veprim q\u00eb nuk ka, direkt apo indirekt, nj\u00eb impakt personal-nd\u00ebrpersonal-social.<\/p>\n<p>Lidhur me sterilizimin e parashikuar n\u00eb projektligj natyrsh\u00ebm lind pyetja: Cili \u00ebsht\u00eb raporti q\u00eb ka njeriu p\u00ebrkundrejt materialit riprodhues t\u00eb tij? A mund ta p\u00ebrdorin materialin gjenetik, t\u00eb cilin e posedon n\u00eb m\u00ebnyr\u00eb t\u00eb pakontrolluar, si n\u00eb rastin e sterilizimit? Ka nj\u00eb ngjashm\u00ebri midis fuqis\u00eb s\u00eb njeriut p\u00ebr t\u00eb menduar dhe t\u00eb shprehurit t\u00eb mendimeve t\u00eb tij pa ndonj\u00eb penges\u00eb apo kufizim? A mund t\u00eb shprehin fuqin\u00eb e tij menduese njeriu pa pa turp e pengesa? Sigurisht q\u00eb jo. Sot jan\u00eb d\u00ebnuar persona t\u00eb ndrysh\u00ebm pasi keqp\u00ebrdor\u00ebn fuqin\u00eb e tyre menduese, duke shprehur mendime t\u00eb konsideruara ekstreme. Po kur njeriu keqp\u00ebrdor materialin gjenetik, a konsiderohet dhe a duhet konsideruar veprim ekstrem?<\/p>\n<p>Lejohet sterilizimi apo dhe aborti kur rrezikohet jeta e n\u00ebn\u00ebs. Pyetja q\u00eb shtrohet \u00ebsht\u00eb: a mund t\u00eb b\u00ebhet nj\u00eb mjek, apo nj\u00eb komision mjek\u00ebsh p\u00ebrcaktues i jet\u00ebs njer\u00ebzore: A i tejkalon kjo kompetencat dhe deontologjin\u00eb mjek\u00ebsore? Nd\u00ebrkoh\u00eb kemi raste kur mjeku ka k\u00ebrkuar me ngulm nd\u00ebrprerjen e shtatz\u00ebnis\u00eb, por kjo \u00ebsht\u00eb refuzuar nga n\u00ebna dhe kan\u00eb jetuar t\u00eb dy, dhe n\u00ebna dhe femija. Shembull q\u00eb refuzon pjes\u00ebrisht mendimin, apo veprimin e mjekut. N\u00eb k\u00ebt\u00eb rast kemi sterilizim, apo dhe nd\u00ebrprerje t\u00eb detyruar t\u00eb shtatz\u00ebnis\u00eb.<\/p>\n<p>Lidhur me abortin p\u00ebrmendur si &#8220;nd\u00ebrprerja e shtatz\u00ebnis\u00eb&#8221;<\/p>\n<p>N\u00eb rastin e abortit, v\u00ebrehet p\u00ebrhapja e nj\u00eb terminologjie t\u00eb paqart\u00eb, si ajo e &#8220;nd\u00ebrprerjes s\u00eb shtatz\u00ebnis\u00eb&#8221;, q\u00eb p\u00ebrdor edhe projektligji, e cila tenton t\u00eb fsheh\u00eb natyr\u00ebn e v\u00ebrtet\u00eb t\u00eb saj dhe t\u00eb zbus\u00eb pesh\u00ebn e r\u00ebnd\u00eb q\u00eb ka n\u00eb opinionin publik. &#8220;Mbase vet\u00eb ky fenomen gjuh\u00ebsor &#8211; kujton Evangelium vitae &#8211; \u00ebsht\u00eb nj\u00eb simptom\u00eb e nj\u00eb problemi t\u00eb nd\u00ebrgjegjeve. Por asnj\u00eb fjal\u00eb nuk mund ta ndryshoj\u00eb realitetin e gj\u00ebrave: aborti i kryer me dashje \u00ebsht\u00eb vrasja e vullnetshme dhe e drejtp\u00ebrdrejt\u00eb e nj\u00eb qenieje njer\u00ebzore n\u00eb faz\u00ebn fillestare t\u00eb ekzistenc\u00ebs s\u00eb saj, q\u00eb p\u00ebrfshin momentin e ngjizjes deri n\u00eb lindje&#8221; (58).<\/p>\n<p>Projektligji shprehet q\u00eb n\u00eb fillim p\u00ebr nd\u00ebrprerjen vullnetare e shtatz\u00ebnis\u00eb, duke mos k\u00ebrkuar arsye. Lind pyetja: Cilat jan\u00eb disa arsye, q\u00eb nj\u00eb veprim t\u00eb nj\u00eb gruaje shtatz\u00ebn\u00eb ta konsiderojm\u00eb vullnetar dhe jo t\u00eb till\u00eb? Flasim p\u00ebr autonomin\u00eb (lirin\u00eb e gruas), por kush kujdeset dhe mbron autonomin\u00eb e foshnj\u00ebs, q\u00eb do lind\u00eb dhe \u00ebsht\u00eb n\u00eb nj\u00eb zhvillim t\u00eb vazhduesh\u00ebm, pavar\u00ebsisht stadit t\u00eb zhvillimit (paraembrion, embrion, fetus),? Pozicionohemi kund\u00ebr nd\u00ebrprerjes vullnetare t\u00eb shtatz\u00ebnis\u00eb, apo kund\u00ebr \u00e7do nd\u00ebrprerje t\u00eb shtatz\u00ebnis\u00eb?<\/p>\n<p>N\u00eb thelb, ligjet jan\u00eb nj\u00eb dh\u00ebnie-marrje midis pal\u00ebve. N\u00ebse ne shkojm\u00eb me l\u00ebshime do t\u00eb thot\u00eb q\u00eb komunikimin nuk e fillojm\u00eb nga pika maksimale, por diku m\u00eb posht\u00eb. D.m.th. n\u00ebse ne flasim vet\u00ebm p\u00ebr nd\u00ebrprerjen vullnetare kemi humbur pik\u00eb n\u00eb dialog, n\u00ebse do na th\u00ebrresin p\u00ebr dialog.<\/p>\n<p>Lidhur me Teknikat e riprodhimit t\u00eb asistuar<\/p>\n<p>&#8211; N\u00eb raportet e riprodhimit artificial in vitro jan\u00eb dy komponente thelb\u00ebsore: materiali gjenetik dhe f\u00ebmija q\u00eb do t\u00eb lind\u00eb. I pari, n\u00eb rastin e n\u00ebn\u00ebs beqare, sipas k\u00ebtij ligji konsiderohet nj\u00eb mall tregu. Nga ana tjet\u00ebr, f\u00ebmija privohet nga p\u00ebrkujdesja at\u00ebrore q\u00eb n\u00eb zanafill\u00eb. A \u00ebsht\u00eb kjo nj\u00eb shkelje e t\u00eb drejt\u00ebs s\u00eb f\u00ebmij\u00ebs p\u00ebr ta larguar dhe paragjykuar babain, i cili n\u00eb realitet \u00ebsht\u00eb prezent n\u00ebp\u00ebrmjet materialit gjenetik? Sa mund t\u00eb ndikoj\u00eb mungesa, jo p\u00ebr shkaqe natyrore, e babait n\u00eb rritjen dhe edukimin e femij\u00ebs? A \u00ebsht\u00eb nj\u00eb shkelje e t\u00eb drejt\u00ebs s\u00eb f\u00ebmij\u00ebs? Nd\u00ebrkoh\u00eb q\u00eb Kodi i Familjes n\u00eb Nenin 5 shprehet q\u00eb f\u00ebmija duhet t\u00eb rritet n\u00eb nj\u00eb mjedis familjar. \u00c7far\u00eb n\u00ebnkupton mjedis familjar? Mos ndoshta n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb kemi bashkim t\u00eb dy gjinive n\u00eb nj\u00eb person t\u00eb vet\u00ebm, tek n\u00ebna?<\/p>\n<p>Lidhur me P\u00ebrdoruesit e teknikave t\u00eb riprodhimit mjek\u00ebsor t\u00eb asistuar<\/p>\n<p>N\u00eb rastin e p\u00ebrdoruesit e teknikave t\u00eb riprodhimit mjek\u00ebsor t\u00eb asistuar kemi tre komponent\u00eb: materiali gjenetik, huazimi i mitr\u00ebs dhe f\u00ebmija. P\u00ebrve\u00e7 konsiderimit t\u00eb materialit gjenetik shtrohen disa paqart\u00ebsi:<\/p>\n<p>Neni 19, pika 2, si dhe Neni 22 flasin p\u00ebr pamund\u00ebsin\u00eb e lindjes s\u00eb f\u00ebmij\u00ebs.. P\u00ebrve\u00e7 problemit t\u00eb mitr\u00ebs (uterus), gruaja mund t\u00eb ket\u00eb dhe pamund\u00ebsin\u00eb e materialit gjenetik (mungesa e vez\u00ebve). At\u00ebher\u00eb materiali gjenetik huazohet nga nj\u00eb grua tjet\u00ebr, pasi sipas pik\u00ebs 2 t\u00eb Nenit 22 p\u00ebrdoret fjala infertile dhe pika 3 e po k\u00ebtij neni shprehet se gruaja nuk mund t\u00eb p\u00ebrdor\u00eb vez\u00ebt e saj. N\u00eb k\u00ebt\u00eb rast kemi tre n\u00ebna, porosit\u00ebsja, mbart\u00ebsja dhe dhuruesja e materialit gjenetik (vez\u00ebve). Si do zhvillohet femija brenda k\u00ebtij kompleksi faktor\u00ebsh? N\u00eb k\u00ebt\u00eb rast kush e mbron t\u00eb drejt\u00ebn e f\u00ebmij\u00ebs, q\u00eb lind pa baba dhe ka dy, apo tre n\u00ebna t\u00eb konsideruara?<\/p>\n<p>Si p\u00ebrfundim, projektligji n\u00eb fjal\u00eb nuk \u00ebsht\u00eb problematik vet\u00ebm p\u00ebr efektet e menj\u00ebhershme q\u00eb shkaktojn\u00eb praktikat e teknikat e propozuara aty p\u00ebrkundrejt jet\u00ebs njer\u00ebzore. E v\u00ebrteta \u00ebsht\u00eb se ligji (ky projektligj), me kalim e koh\u00ebs, krijon nj\u00eb stil jete, nj\u00eb kultur\u00eb (vdekjeje), nj\u00eb mend\u00ebsi, q\u00eb e mbyt p\u00ebrgjegjshm\u00ebrin\u00eb n\u00eb marr\u00ebdh\u00ebniet nd\u00ebrpersonale, dhe u b\u00ebn vend ideologjive e sistemeve, q\u00eb nuk p\u00ebrputhen me t\u00eb v\u00ebrtet\u00ebn e dinjitetit njer\u00ebzor &#8211; teknokracia, transhumanizmi etj..<\/p>\n<p>Krahas argumenteve t\u00eb m\u00ebsip\u00ebrme, shtojm\u00eb se pozicionimin e Parlamentit Evropian i miratuar n\u00eb leximin e par\u00eb m\u00eb 23 prill 2024 me q\u00ebllim miratimin e Direktiv\u00ebs (BE) 2024\/&#8230; t\u00eb Parlamentit Evropian dhe t\u00eb K\u00ebshillit, q\u00eb ndryshon:<\/p>\n<p>Direktiv\u00ebn 2011\/36\/BE p\u00ebr parandalimin dhe shtypjen e trafkimi i qenieve njer\u00ebzore dhe mbrojtja e viktimave, ndryshimet n\u00eb Direktiv\u00ebn 2011\/36\/BE Direktiva 2011\/36\/BE, i cili ndalon shfryt\u00ebzimin dhe z\u00ebvend\u00ebsimin m\u00ebm\u00ebsis\u00eb surrogato, martes\u00ebn e detyruar ose bir\u00ebsimin ilegal, t\u00eb cilat mund t\u00eb p\u00ebrfshihet tashm\u00eb n\u00eb sfer\u00ebn e krimeve t\u00eb lidhura me trafikimin e qenieve njer\u00ebzore si\u00e7 p\u00ebrcaktohet n\u00eb Direktiv\u00ebn 2011\/36\/BE, n\u00eb mas\u00ebn q\u00eb plot\u00ebsohen t\u00eb gjitha kriteret q\u00eb p\u00ebrb\u00ebjn\u00eb k\u00ebto krime. Kjo Direktiv\u00eb e v\u00eb theksin gjithashtu tek ata q\u00eb ata i detyrojn\u00eb ose mashtrojn\u00eb grat\u00eb, q\u00eb t\u00eb veprojn\u00eb si n\u00ebna surrogate.<\/p>\n<p>I. ASPEKTI TEOLOGJIK<\/p>\n<p>N\u00eb k\u00ebt\u00eb aspekt krahas mendimit shoq\u00ebror dhe etik p\u00ebrfshihet n\u00eb to edhe mendimi teologjik. Kjo p\u00ebrfshirje lidhet me faktin se mendimi teologjik \u00ebsht\u00eb zhvilluar dhe zhvillohet brenda dukurive sociale dhe t\u00eb cilat kan\u00eb nj\u00eb shtrat etik, i cili \u00ebsht\u00eb frym\u00ebzuar prej mendimit teologjik.
