Nj\u00eb vendim i<br \/>\ngjykat\u00ebs Tiran\u00eb, i dhjetorit 1996, e anu-<br \/>\nllonte k\u00ebt\u00eb vendim, duke v\u00ebrtetuar, se<br \/>\nKisha. nuk kishte asnj\u00eb detyrim ndaj<br \/>\nz. Murati. Mbas k\u00ebtij vendimi parat\u00eb<br \/>\nduhej t\u00eb ktheheshin n\u00eb llogarin\u00eb ton\u00eb,<br \/>\npor&#8230; Dega e Thesarit, n\u00eb kund\u00ebrshtim<br \/>\nme ligjin, ia kishte dh\u00ebn\u00eb ato z. Murati!<br \/>\nPor, si ishte zhvilluar gjith\u00eb<br \/>\nkjo histori?<br \/>\nKisha Orthodhokse Autoqefale e<br \/>\nShqip\u00ebris\u00eb nuk kishte asnj\u00eb lidhje me<br \/>\nvendimin e m\u00ebsip\u00ebrm dhe as me z. Mu\u00ad<br \/>\nrati. Nd\u00ebrsa vendimi i gjykat\u00ebs \u00ebsht\u00eb<br \/>\nabsurd dha pa asnj\u00eb baz\u00eb ligjore edhe<br \/>\nm\u00eb i r\u00ebnd\u00eb ishte veprimi i Deg\u00ebs s\u00eb<br \/>\nThesarit, q\u00eb pa urdh\u00ebr nga P\u00ebrmbari-<br \/>\nmi, b\u00ebri menj\u00ebher\u00eb dhe n\u00eb m\u00ebnyr\u00eb<br \/>\nshum\u00eb t\u00eb dyshimt\u00eb pages\u00ebn e parave.<br \/>\nZanafilla ishte tek nj\u00eb gjykim rreth<br \/>\nkonfliktit nd\u00ebrmjet z. Myzafer Murati<br \/>\ndhe pronar\u00ebve t\u00eb Markatos nr.6 tek<br \/>\nrruga Ali Demi, q\u00eb i detyronte k\u00ebta t\u00eb<br \/>\nfundit t\u2019i kthenin borxhin z. Murati, me<br \/>\nnj\u00eb vler\u00eb 6,616  milion\u00eb lek\u00eb.<br \/>\nMe an\u00eb t\u00eb kontrat\u00ebs t\u00eb dt. 30 korrik<br \/>\n1993, Kisha bleu nga pronar\u00ebt marka-<br \/>\nton n\u00eb fjal\u00eb dhe pas disa mosmarr\u00ebve-<br \/>\nshjesh, m\u00eb 11 mars 1994, KOASH  pa-<br \/>\ngoi t\u00eb gjitha parat\u00eb, duke u b\u00ebr\u00eb prona-<br \/>\nre e godin\u00ebs dhe q\u00eb nga ajo dit\u00eb mbaron<br \/>\nedhe \u00e7do lidhje me ish-pronar\u00ebt. K\u00ebtu<br \/>\nfillojn\u00eb edhe veprimet e kundra-<br \/>\nligjshme.<br \/>\nKat\u00ebr muaj pasi Kisha ishte b\u00ebr\u00eb<br \/>\nplot\u00ebsisht pronare e objektit, Gjykata<br \/>\ne rrethit Tiran\u00eb rigjykoi \u00e7\u00ebshtjen Mu-<br \/>\nrati-ish-pronar\u00ebt e Markatos nr. 6, m\u00eb<br \/>\n20 korrik 1994, n\u00eb favor t\u00eb z. Murati,<br \/>\nvendim q\u00eb mbeti n\u00eb fuqi edhe nga Ka-<br \/>\nsacioni. K\u00ebshtu, ish-pronar\u00ebt e Mar\u00ad<br \/>\nkatos duhej t\u2019i paguanin atij shum\u00ebn<br \/>\nq\u00eb i detyroheshin. Pas k\u00ebsaj nis edhe<br \/>\nabsurdi: Dy vjet pas gjykimit, Zyra e<br \/>\nP\u00ebrmbarimit, pa marr\u00eb parasysh se<br \/>\nKisha Orthodhokse nuk u detyrohej as<br \/>\nedhe nj\u00eb lek ish-pronar\u00ebve, q\u00eb nga<br \/>\nmarsi 1994, sekuestron llogarin\u00eb e saj<br \/>\nbankare, me 4,016  milion\u00eb lek\u00eb. Ky ve\u00ad<br \/>\nndim u kund\u00ebrshtua menj\u00ebher\u00eb n\u00eb gjy-<br \/>\nkat\u00eb, dhe pas 6 muajsh doli vendimi,<br \/>\nkuptohet n\u00eb favor t\u00eb Kish\u00ebs Orthodho\u00ad<br \/>\nkse Autoqefale t\u00eb Shqip\u00ebris\u00eb. Por, nd\u00ebr-<br \/>\nkoh\u00eb, n\u00eb kund\u00ebrshtim flagrant me \u00e7do<br \/>\nligj n\u00eb fuqi, Dega e Thesarit ia kishte<br \/>\nkaluar parat\u00eb e Kish\u00ebs z. Murati. Nd\u00ebr-<br \/>\nkaq, protesta dhe k\u00ebrkesa p\u00ebr t\u00eb v\u00ebn\u00eb<br \/>\nn\u00eb vend k\u00ebt\u00eb padrejt\u00ebsi iu ishin drejtu-<br \/>\nar Presidentit, Kryeministrit, Ministrit<br \/>\nt\u00eb Financave dhe atij t\u00eb Drejt\u00ebsis\u00eb, si<br \/>\ndhe Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm, por u<br \/>\nmor p\u00ebrgjigje vet\u00ebm nga Prokurori, se:<br \/>\n\u201c\u00c7\u00ebshtja pushohet, sepse nuk ka<br \/>\nshkelje ligjore\u201d!&#8230;<br \/>\nM\u00eb 24 shkurt 1997, me nj\u00eb padi n\u00eb<br \/>\nGjykat\u00ebn e Faktit t\u00eb Tiran\u00ebs, u k\u00ebrkua<br \/>\nq\u00eb Dega e Thesarit t\u00eb kthente d\u00ebmin e<br \/>\nshkaktuar. Mbas 19 seancash gjyq\u00eb-<br \/>\nsore, vendimi ishte n\u00eb favorin ton\u00eb, por<br \/>\nDega e Thesarit u ankua n\u00eb gjykat\u00ebn e<br \/>\nApelit, e cila e ktheu edhe nj\u00eb her\u00eb \u00e7\u00eb-<br \/>\nshtjen p\u00ebr rigjykim n\u00eb shkall\u00ebn e par\u00eb.<br \/>\nU zhvilluan edhe 13 seanca t\u00eb tjera,<br \/>\npor, kur pritej dh\u00ebnia e vendimit, u k\u00ebr-<br \/>\nkua nga Dega Thessarit p\u00ebrjashtimi i<br \/>\ngjyqtarit. Por edhe gjyqtarja e re, q\u00eb e<br \/>\nmori \u00e7\u00ebshtjen, nuk plot\u00ebsonte kushtet<br \/>\nligjore, sepse kishte dh\u00ebn\u00eb m\u00eb par\u00eb nj\u00eb<br \/>\nvendim n\u00eb favor t\u00eb z. Murati, n\u00eb gjyki-<br \/>\nmin me pronar\u00ebt e Markatos 6&#8230; Q\u00eb<br \/>\nnga ky pezullim i fundit kan\u00eb kaluar<br \/>\ngati 4 muaj dhe nuk \u00ebsht\u00eb caktuar<br \/>\ngjykat\u00ebs tjet\u00ebr, nd\u00ebrkoh\u00eb q\u00eb i jan\u00eb<br \/>\nd\u00ebrguar edhe dy letra kryetarit t\u00eb<br \/>\ngjykat\u00ebs&#8230;<br \/>\nK\u00ebshtu, kalojn\u00eb muajt, vitet dhe<br \/>\nparave e Kish\u00ebs, t\u00eb mbledhura nga<br \/>\nkontributi i besimtar\u00ebve orthodhoks\u00eb,<br \/>\nvazhdon t\u00eb mos u dihet fati. Dhe sa kjo<br \/>\nka t\u00eb b\u00ebj\u00eb me munges\u00ebn e zbatimit t\u00eb<br \/>\nligjit \u00ebsht\u00eb pak a shum\u00eb e qart\u00eb. M\u00eb<br \/>\npak e dukshme \u00ebsht\u00eb ajo, se sa k\u00ebto ve-<br \/>\nprime jan\u00eb t\u00eb q\u00ebllimshme ndaj komu-<br \/>\nnitetit ton\u00eb. Sepse v\u00ebshtir\u00eb t\u00eb mendo-<br \/>\nhet se do t\u00eb isht\u00eb zvarritur k\u00ebshtu \u00e7\u00eb-<br \/>\nshtja, po qe se kjo vjedhje do t\u2019i kishte<br \/>\nndodhur dikujt tjet\u00ebr. Por, gjithsesi,<br \/>\nende \u00ebsht\u00eb e mundur t\u00eb rivendoset e<br \/>\ndrejta. Argumentat ligjore jan\u00eb fare t\u00eb<br \/>\nqarta.
