Flet <em>\u201cp\u00ebr artikujt kritik\u00eb q\u00eb u botuan gjat\u00eb tri viteve t\u00eb fundit.\u201d<\/em> Nuk b\u00ebhet fjal\u00eb aspak p\u00ebr \u201cartikuj kritik\u00eb\u201d, por p\u00ebr disa pamflete t\u00eb pamenduara mir\u00eb. Tre t\u00eb par\u00ebt e pan\u00eb drit\u00ebn e botimit n\u00eb vjesht\u00ebn e vitit 2010 dhe dy t\u00eb tjer\u00ebt dol\u00ebn m\u00eb s\u00eb fundi. Zoti Frash\u00ebri nuk i num\u00ebron sakt\u00eb. Kurr\u00eb nuk kisha dh\u00ebn\u00eb shkak dhe as nuk kisha th\u00ebn\u00eb asnj\u00eb fjal\u00eb kund\u00ebr z. Frash\u00ebri. P\u00ebrkundrazi, kisha treguar gjithmon\u00eb vler\u00ebsim. Papritur, m\u00eb 14 shtator 2010, tet\u00ebmb\u00ebdhjet\u00eb vjet pas marrjes p\u00ebrsip\u00ebr t\u00eb p\u00ebrgjegj\u00ebsis\u00eb s\u00eb Kryepiskopit, doli me nj\u00eb akuz\u00eb shpif\u00ebse publike. Vijuan, te <em>Gazeta Shqiptare<\/em>, dhe dy pamflete t\u00eb tjera (9-10\/10\/2010 dhe m\u00eb 16-17\/11\/2010), n\u00eb t\u00eb cilat b\u00ebri shpifje t\u00eb tjera me nj\u00eb agresivitet t\u00eb \u00e7uditsh\u00ebm. P\u00ebrgjigjet e mia u botuan n\u00eb t\u00eb nj\u00ebjt\u00ebn gazet\u00eb, m\u00eb 26\/9 dhe 31\/10 2010 dhe e fundit m\u00eb 5\/12\/2010. Pas sulmit t\u00eb tij t\u00eb fundit shpif\u00ebs, i parashtrova t\u00eb dh\u00ebna konkrete q\u00eb zbulonin keqinterpretimet dhe gabimet e tij serioze historike. P\u00ebrmbledhtazi, po rikujtoj tre prej tyre, q\u00eb tregojn\u00eb nivelin e \u201cartikujve t\u00eb tij kritik\u00eb\u201d:<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; (a) \u201cZ. Frash\u00ebri i ka siguruar p\u00ebr 14 her\u00eb lexuesit, se statuti i vitit 1929 \u00ebsht\u00eb miratuar dhe \u00ebsht\u00eb ratifikuar nga Tomosi Patriarkal me t\u00eb cilin, m\u00eb 12 prill 1937, Kish\u00ebs Orthodhokse t\u00eb Shqip\u00ebris\u00eb iu dha Autoqefalia. Meq\u00eb teksti n\u00eb fjal\u00eb ka r\u00ebnd\u00ebsi themeltare, po e shtojm\u00eb n\u00eb materialet shoq\u00ebruese t\u00eb k\u00ebtij artikulli, t\u00eb plot\u00eb, si dhe fotokopjen e origjinalit (shih Gazeta Shqiptare, 5\/12\/2010). Si\u00e7 mund ta konstatoj\u00eb edhe lexuesi m\u00eb i thjesht\u00eb, n\u00eb k\u00ebt\u00eb dokument, n\u00eb asnj\u00eb pik\u00eb t\u00eb tij\u00ebn nuk p\u00ebrmendet statuti i vitit 1929\u201d. (b) \u201cNgutet t\u00eb siguroj\u00eb p\u00ebr znj. Antoniadhu <em>\u201c&#8230;dyshoj se nuk \u00ebsht\u00eb greke, por shqiptare &#8211; nga familja e njohur shqiptare himarjote Andoni dhe q\u00eb si grekomane ka nd\u00ebrruar dhe mbiemrin, &#8230;s\u00eb bashku me mbiemrin ka nd\u00ebrruar edhe nd\u00ebrgjegjen\u201d.<\/em> Por ajo \u00ebsht\u00eb nj\u00eb gazetare e shquar e nj\u00eb prej gazetave m\u00eb t\u00eb njohura t\u00eb Athin\u00ebs dhe sa e njohin, qeshin me k\u00ebt\u00eb gjetje historike, ngaq\u00eb dihet se familja e saj e ka prejardhjen nga Ponti i Azis\u00eb s\u00eb Vog\u00ebl.\u201d (c) \u201cPor aty ku ai kalon \u00e7do lloj caku t\u00eb seriozitetit historik \u00ebsht\u00eb kur del n\u00eb p\u00ebrfundimin se <em>\u201cKrishti dha porosi tek apostuj t\u00eb krijojn\u00eb Kisha komb\u00ebtare dhe ky parim u shkel nga Patriarkana Ekumenike\u201d.<\/em> \u00c7do i krishter\u00eb i arsimuar mund t\u00eb kuptoj\u00eb nivelin e dijeve dhe vlefshm\u00ebrin\u00eb e atyre q\u00eb thot\u00eb historiani n\u00eb lidhje me theologjin\u00eb dhe Kish\u00ebn\u201d.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Pas zbulimit t\u00eb nivelit t\u00eb argumenteve t\u00eb z. Frash\u00ebri, ai heshti p\u00ebr tre vjet me radh\u00eb. Papritur, duke p\u00ebrdorur si pik\u00ebnisje ngjarjet e hidhura t\u00eb P\u00ebrmetit, nisi p\u00ebrs\u00ebri (26\/8\/2013) me sulme dhe akuza t\u00eb reja.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; N\u00eb \u00e7do rast me shkrimin e pamfleteve t\u00eb tij p\u00ebrpiqet t\u00eb krijoj\u00eb nj\u00eb teat\u00ebr absurd. Merr p\u00ebrsip\u00ebr p\u00ebr veten rolin e akuzuesit, t\u00eb hetuesit, t\u00eb prokurorit, t\u00eb gjykat\u00ebsit dhe disa her\u00eb edhe t\u00eb shefit t\u00eb policis\u00eb private, p\u00ebr t\u00eb d\u00ebbuar Kryepiskopin. Dhe na i cakton k\u00ebtij t\u00eb fundit rolin e fajtorit q\u00eb shfaj\u00ebsohet. Por, p\u00ebrgjigjet e mia nuk jan\u00eb \u201capologji\u201d, si\u00e7 i pag\u00ebzon ai, por tekste sqaruese q\u00eb hedhin posht\u00eb akuza dhe pik\u00ebpamje t\u00eb pabaza. Si shkenc\u00ebtar i p\u00ebrgjegjsh\u00ebm dhe udh\u00ebheq\u00ebs kishtar, jam i detyruar me guxim dhe argumente t\u00eb hedh posht\u00eb shpifjet e padrejta q\u00eb kan\u00eb si q\u00ebllim t\u00eb tyrin, t\u00eb helmojn\u00eb opinionin publik.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t&nbsp;<\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\"><strong>&nbsp;&nbsp; 2. <\/strong>Por le t\u00eb vijm\u00eb te pamfleti i tij i pest\u00eb (me t\u00eb cilin i p\u00ebrgjigjet kritik\u00ebs son\u00eb, q\u00eb u botua m\u00eb 22-23.9.2013). (E vonova k\u00ebt\u00eb p\u00ebrgjigje p\u00ebr shkak t\u00eb nj\u00eb s\u00ebr\u00eb udh\u00ebtimesh t\u00eb mia jasht\u00eb vendit).<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; a) N\u00eb lidhje me ngjarjet e P\u00ebrmetit mb\u00ebshtet mendimin se n\u00eb filmimet e ngjarjes \u201c<em>nuk shihet asnj\u00eb goditje \u201ce pam\u00ebshirshme\u201d t\u00eb asnj\u00eb prifti nga policia&#8230; Ato jan\u00eb shpifje monstruoze t\u00eb pakonceptueshme, kur dalin nga pena e nj\u00eb prelati, i cili kudo ku shkon prezantohet me titullin \u201cDoktor, Profesor dhe An\u00ebtar Nderi i Akademis\u00eb s\u00eb Athin\u00ebs\u201d<\/em>. Videoja \u00ebsht\u00eb n\u00eb dispozicion t\u00eb cilitdo q\u00eb d\u00ebshiron ta shikoj\u00eb (<a href=\"http:\/\/www.orthodoxalbania.org\/al\/index.php\/shq\/lajme\/1425-proteste-e-klerikeve-te-mitropolise-se-shenjte-te-gjirokastres\">http:\/\/www.orthodoxalbania.org\/al\/index.php\/shq\/lajme\/1425-proteste-e-klerikeve-te-mitropolise-se-shenjte-te-gjirokastres<\/a>) dhe po sjellim disa prej k\u00ebtyre pamjeve me foto. Kjo video u transmetua n\u00eb mbar\u00eb bot\u00ebn dhe shkaktoi nj\u00eb protest\u00eb nd\u00ebrkomb\u00ebtare. Nd\u00ebrsa z. Frash\u00ebri pohon se \u201c<em>nuk shihet asnj\u00eb goditje \u201ct\u00eb pam\u00ebshirshme\u201d nga policia\u201d<\/em>. Dhun\u00ebn kund\u00ebr prift\u00ebrinjve shqiptar\u00eb e kan\u00eb par\u00eb shum\u00eb d\u00ebshmitar\u00eb okular\u00eb. Si nj\u00eb prej shembujve t\u00eb shumt\u00eb, po sjell denoncimin e klerikut shqiptar Ilia Tyto (52 vje\u00e7), i cili denoncoi n\u00eb prokurori, m\u00eb 16 gusht 2013, se an\u00ebtar\u00ebt e policis\u00eb private \u201cfilluan t\u00eb m\u00eb godasin me grushte dhe shkelma dhe nga k\u00ebto goditje kam ngelur i d\u00ebmtuar n\u00eb buz\u00eb si edhe kam&nbsp; d\u00ebmtime t\u00eb qaf\u00ebs, si dhe n\u00eb pjes\u00ebn e kryqes s\u00eb majt\u00eb, si dhe n\u00eb ky\u00e7in e k\u00ebmb\u00ebs s\u00eb djatht\u00eb dhe me forc\u00eb m\u00eb kan\u00eb t\u00ebrhequr zvarr\u00eb nga kisha p\u00ebr n\u00eb trotuar&#8230; Q\u00ebndrova disa minuta i rrethuar nga ata derisa erdhi Papa Thanas Qerimi, i cili m\u00eb ka marr\u00eb menj\u00ebher\u00eb me vete dhe jemi drejtuar p\u00ebr n\u00eb polici p\u00ebr t\u00eb b\u00ebr\u00eb k\u00ebt\u00eb kall\u00ebzim penal\u201d (Republika e Shqip\u00ebris\u00eb, Prokuroria e Rrethit Gjyq\u00ebsor P\u00ebrmet. Proces-verbali p\u00ebr kall\u00ebzimin e vepr\u00ebs&nbsp; penale, 16\/8\/2013) (shih dokumenti 1 dhe 2)<\/span><\/span><\/span><span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">. N\u00eb 19\/8\/2013, at\u00eb e vizitoi mjeku ligjor, Frederik Kekezi, i cili konstatoi \u201ckontuzion i trupit (ekimoz\u00eb, enjtje), d\u00ebmtimet e m\u00ebsip\u00ebrme jan\u00eb shkaktuar nga nj\u00eb mjet mbret\u00ebs\u201d (Akt-ekspertimi mjeko-ligjor nr.310, Sh\u00ebrbimi i Mjek\u00ebsis\u00eb Ligjore, Gjirokast\u00ebr). <\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Z. Frash\u00ebri ngul k\u00ebmb\u00eb se k\u00ebto dhe flakja e Ungjillit \u201c<em>jan\u00eb shpifje monstruoze&#8230;\u201d, \u201c&#8230;kuptohet se n\u00eb k\u00ebt\u00eb mes Zyra e P\u00ebrmbarimit nuk kreu ndonj\u00eb sakrilegj\u201d<\/em>. Gjithashtu, ka d\u00ebshmi t\u00eb pakund\u00ebrshtueshme dhe foto, q\u00eb tregojn\u00eb qart\u00eb se ungjijt\u00eb, ikonat dhe en\u00ebt e shenjta u flak\u00ebn n\u00eb makin\u00ebn e plehrave t\u00eb Bashkis\u00eb (shih dok. 3). K\u00ebshtu p\u00ebrkufizimi \u201cshpifje monstruoze\u201d n\u00eb k\u00ebt\u00eb rast kthehet kund\u00ebr vet\u00eb k\u00ebtij personi, i cili vet\u00ebquhet mbrojt\u00ebsi i sakrilegjit.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; P\u00ebrsa i takon titujve t\u00eb mi shkencor\u00eb (t\u00eb nj\u00eb r\u00ebnd\u00ebsie nd\u00ebrkomb\u00ebtare), sipas taktik\u00ebs s\u00eb apostull Pavlit, i cili u kujtonte p\u00ebrndjek\u00ebsve t\u00eb tij se \u201cjam qytetar romak\u201d, edhe un\u00eb i p\u00ebrdor kryesisht kur na duhet t\u2019u p\u00ebrgjigjemi disa artikullshkruesve, t\u00eb cil\u00ebt, p\u00ebr t\u2019i dh\u00ebn\u00eb autoritet pamfleteve t\u00eb tyre antishkencore, n\u00eb krye t\u00eb shkrimeve t\u00eb tyre vendosin sigl\u00ebn \u201cProf. dr. historian, akademik\u201d.&nbsp;<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; b) P\u00ebr sa i takon dat\u00ebs s\u00eb sakt\u00eb t\u00eb ngritjes s\u00eb nd\u00ebrtes\u00ebs s\u00eb par\u00eb t\u00eb kish\u00ebs jan\u00eb b\u00ebr\u00eb studime t\u00eb ndryshme. Nj\u00eb t\u00eb dh\u00ebn\u00eb t\u00eb r\u00ebnd\u00ebsishme, se sa e vjet\u00ebr \u00ebsht\u00eb kisha e s\u00eb T\u00ebr\u00ebshenjt\u00ebs n\u00eb P\u00ebrmet, na e jep studiuesi p\u00ebrmetar Stilian Adhami, n\u00eb vepr\u00ebn e tij <em>\u201cP\u00ebrmeti dhe p\u00ebrmetar\u00ebt n\u00eb udh\u00ebn e historis\u00eb (Nga lasht\u00ebsia deri n\u00eb vitin 1939)\u201d,<\/em> (Botimet Ada, Tiran\u00eb 2001, fq. 168), kur thot\u00eb se <em>\u201cduhet t\u00eb jet\u00eb kisha m\u00eb e vjet\u00ebr e qytetit\u201d<\/em>.&nbsp; Dy kishat e tjera t\u00eb qytetit ajo e Sh\u00ebn Nikoll\u00ebs dhe Sh\u00ebn e Premtes, u nd\u00ebrtuan n\u00eb vitin 1747 dhe n\u00eb vitin 1776. Pik\u00ebpamjen se kjo kish\u00eb ka ekzistuar q\u00eb n\u00eb shekullin e 17-t\u00eb e ka formuluar edhe dr. K. Jakumis me baz\u00eb traditat lokale. Si\u00e7 vihet re, n\u00eb shum\u00eb raste ka disa rind\u00ebrtime n\u00eb ambientet fillestare t\u00eb nj\u00eb kishe. N\u00ebse nuk tregojn\u00eb gj\u00eb tjet\u00ebr, k\u00ebto fakte d\u00ebshmojn\u00eb se kisha nuk u nd\u00ebrtua n\u00eb vitin 1930, si\u00e7 d\u00ebshiron historiani Frash\u00ebri. Por edhe d\u00ebshmia e S. Adhamit \u00ebsht\u00eb shum\u00eb e qart\u00eb, kur thot\u00eb se kisha duhet t\u00eb jet\u00eb para vitit 1747, \u201cpasi \u00ebsht\u00eb m\u00eb e vjetra\u201d, akoma edhe m\u00eb e vjet\u00ebr se ajo e Sh\u00ebn Nikoll\u00ebs, e nd\u00ebrtuar n\u00eb k\u00ebt\u00eb dat\u00eb. Frash\u00ebri ngul k\u00ebmb\u00eb se nuk d\u00ebshirojm\u00eb ekzistenc\u00ebn e qendr\u00ebs kulturore n\u00eb P\u00ebrmet, se gjoja kemi synim greqizimin e qytetit! K\u00ebto jan\u00eb dyshime fare t\u00eb pabaza! E p\u00ebrs\u00ebrisim: (1) Gjat\u00eb gjith\u00eb k\u00ebtyre viteve n\u00eb kish\u00ebn e s\u00eb T\u00ebr\u00ebshenjt\u00ebs s\u00eb P\u00ebrmetit meshohet n\u00eb shqip, nga prift\u00ebrinj shqiptar\u00eb. Ka kaq shum\u00eb nevoj\u00eb bashkia e vog\u00ebl e P\u00ebrmetit p\u00ebr nj\u00eb Qend\u00ebr Kulturore t\u00eb dyt\u00eb&#8230; aq sa t\u00eb kryente veprimet e sakrilegjit q\u00eb e njollos\u00ebn vendin ton\u00eb nd\u00ebrkomb\u00ebtarisht? Cila bashki tjet\u00ebr n\u00eb vend ka dy qendra kulturore?! Q\u00ebllimet n\u00eb k\u00ebt\u00eb rast jan\u00eb krejt\u00ebsisht t\u00eb nj\u00eb natyre tjet\u00ebr dhe nuk b\u00ebhet fjal\u00eb aspak p\u00ebr kultur\u00ebn. P\u00ebr m\u00eb tep\u00ebr, planet e k\u00ebsaj qendre iu paraqit\u00ebn bashkis\u00eb nga nj\u00eb bashk\u00ebpun\u00ebtor i yni. (4) Mb\u00ebshtet tez\u00ebn se ngulim k\u00ebmb\u00eb n\u00eb kthimin e kish\u00ebs s\u00eb vjet\u00ebr, duke pasur n\u00eb t\u00eb v\u00ebrtet\u00eb si q\u00ebllim t\u00eb fsheht\u00eb, helenizimin e qytetit. Por le t\u00eb supozojm\u00eb se n\u00eb vend t\u00eb kthimit, si\u00e7 propozon z. profesor, aty pran\u00eb do t\u00eb nd\u00ebrtohet nj\u00eb kish\u00eb e re, a do t\u00eb largohet rreziku q\u00eb fantazon?&nbsp;<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; N\u00eb nj\u00eb pik\u00eb tjet\u00ebr shkruan: <em>\u201c&#8230;.hir\u00ebsia thot\u00eb se ngjarjet e P\u00ebrmetit i ka m\u00ebsuar m\u00eb von\u00eb. Edhe k\u00ebtu g\u00ebnjen. Shihni apologjin\u00eb e tij t\u00eb dyt\u00eb, t\u00eb cil\u00ebn e ka botuar n\u00eb \u201cGazet\u00ebn Shqiptare\u201d, m\u00eb 3 dhjetor 2010, ku e mbron me k\u00ebmb\u00ebngulje \u00e7\u00ebshtjen e kish\u00ebs s\u00eb P\u00ebrmetit<\/em>\u201d. Por ngjarjet e sakrilegjit t\u00eb P\u00ebrmetit, pra ato q\u00eb ndodh\u00ebn m\u00eb 16 gusht 2013, ishte e pamundur t\u2019i dija m\u00eb 2010. Pa dashur, z. Frash\u00ebri na vesh aft\u00ebsi profetike. N\u00eb p\u00ebrgjigjen time t\u00eb fundit&nbsp; (9.9.2013), shkruaja: \u201ce siguroj se i m\u00ebsova ngjarjet m\u00eb pas (e sigurisht q\u00eb me k\u00ebt\u00eb, n\u00ebnkuptoja ngjarjen e sakrilegjit). Klerik\u00ebt dhe besimtar\u00ebt orthodhoks\u00eb nuk kan\u00eb nevoj\u00eb p\u00ebr urdhra p\u00ebr t\u00eb mbrojtur t\u00eb shenjtat dhe t\u00eb hirshmet\u201d. Kushdo q\u00eb ka ndjekur k\u00ebshill\u00ebn e tij, ka par\u00eb se m\u00eb 3\/12\/2010 nuk ka ekzistuar asnj\u00eb p\u00ebrgjigje e imja n\u00eb <em>Gazeta Shqiptare<\/em>. P\u00ebrgjigjja e tret\u00eb u botua m\u00eb 5\/12\/2010, por prap\u00ebseprap\u00eb edhe n\u00eb k\u00ebt\u00eb rast, nuk ekziston asnj\u00eb referim p\u00ebr P\u00ebrmetin. Sigurisht q\u00eb kam pasur njohuri prej vitesh n\u00eb lidhje me \u00e7\u00ebshtjen pezull q\u00eb ekzistonte n\u00eb P\u00ebrmet n\u00eb lidhje me kish\u00ebn e s\u00eb T\u00ebr\u00ebshenjt\u00ebs Mari.&nbsp;<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; c) Duke pasur t\u00eb gjith\u00eb respektin e duhur p\u00ebr drejt\u00ebsin\u00eb, \u00ebsht\u00eb e njohur se vendimet e gjykatave nuk p\u00ebrb\u00ebjn\u00eb kritere t\u00eb s\u00eb v\u00ebrtet\u00ebs n\u00eb lidhje me \u00e7\u00ebshtjet arkeologjike dhe historike. Shum\u00eb her\u00eb, t\u00eb dh\u00ebna t\u00eb fabrikuara dhe d\u00ebshmitar\u00eb t\u00eb rrem\u00eb sjellin vendime t\u00eb gabuara e t\u00eb pabazuara n\u00eb t\u00eb v\u00ebrtet\u00ebn. N\u00eb lidhje me peripecit\u00eb gjyq\u00ebsore p\u00ebr \u00e7\u00ebshtjen e kish\u00ebs n\u00eb P\u00ebrmet, njoftojm\u00eb opinionin publik se nga viti 1994 deri n\u00eb vitin 2003, pati nj\u00eb seri gjyqesh, ku Kish\u00ebs iu njoh e drejta e saj. Sa i takon vendimit m\u00eb t\u00eb fundit, n\u00eb p\u00ebrs\u00ebritjen e gjyqeve, q\u00eb solli n\u00eb vendimin e njohur, n\u00eb k\u00ebt\u00eb rast pala ankimuese nuk ishte Bashkia e P\u00ebrmetit, q\u00eb e kishte me ligj k\u00ebt\u00eb t\u00eb drejt\u00eb si person juridik, por drejtoria e Qendr\u00ebs Kulturore (q\u00eb ishte nj\u00eb sektor i Bashkis\u00eb pa pasur qenie juridike). Gjithashtu, ekspert\u00ebt nuk u caktuan prej gjykat\u00ebs, por u imponuan. Relatori i \u00e7\u00ebshtjes nuk u caktua me short midis gjyqtar\u00ebve, por u em\u00ebrua nominalisht, si dhe u b\u00ebn\u00eb&nbsp; shkelje t\u00eb tjera.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; \u201cGrupi Shqiptar i t\u00eb Drejtave t\u00eb Njeriut\u201d n\u00eb nj\u00eb deklarat\u00eb t\u00eb tij\u00ebn thekson se \u201c\u00ebsht\u00eb n\u00eb dijeni t\u00eb plot\u00eb t\u00eb t\u00eb gjith\u00eb situat\u00ebs, q\u00eb ka p\u00ebrfunduar me nj\u00eb vendim gjyq\u00ebsor t\u00eb diskutuesh\u00ebm n\u00eb favor t\u00eb pal\u00ebs t\u00eb Bashkis\u00eb&#8230; Ky akt nuk \u00ebsht\u00eb vet\u00ebm nj\u00eb ekzekutim rutin\u00eb i nj\u00eb vendimi gjyq\u00ebsor, por d\u00ebshmon haptazi nj\u00eb procedur\u00eb tipike n\u00ebn frym\u00ebn e urrejtjes fetare p\u00ebr k\u00ebt\u00eb komunitet\u201d (Tiran\u00eb, 18.8.2013, Deklarat\u00eb p\u00ebr Shtyp: \u201cDhunimi i institucionit t\u00eb Kish\u00ebs s\u00eb Sh\u00ebn M\u00ebris\u00eb n\u00eb P\u00ebrmet \u00ebsht\u00eb nj\u00eb precedent i rreziksh\u00ebm i urrejtjes fetare\u201d). Gjithashtu, \u00ebsht\u00eb e njohur se Gjykata Evropiane e t\u00eb Drejtave t\u00eb Njeriut (shih <em>Gazeta Shqiptare<\/em>, 14\/9\/2013 dhe gazeta t\u00eb tjera), ka pranuar p\u00ebr gjykim 561 apelime t\u00eb qytetar\u00ebve shqiptar\u00eb, 80% e t\u00eb cilave kan\u00eb t\u00eb b\u00ebjn\u00eb me kthimin e pronave, q\u00eb shteti u kishte konfiskuar. Dhe ambasadori amerikan n\u00eb Tiran\u00eb A. Arvizu komenton se \u201cproblemi n\u00eb Shqip\u00ebri \u00ebsht\u00eb serioz. Sipas Transparency International, nj\u00eb organizat\u00eb shum\u00eb serioze,&#8230; mbi 80% e shqiptar\u00ebve e shikon sistemin e tyre gjyq\u00ebsor si t\u00eb korruptuar ose tej mase t\u00eb korruptuar\u201d.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Nj\u00eb tjet\u00ebr prov\u00eb e ngurrimit t\u00eb organeve t\u00eb tjera shtet\u00ebrore n\u00eb lidhje me drejt\u00ebsin\u00eb e vendimit, \u00ebsht\u00eb fakti se p\u00ebr n\u00ebnt\u00eb vjet rresht, ky vendim nuk u zbatua. N\u00eb diskutime me zyrtar\u00eb kompetent\u00eb na ishte dh\u00ebn\u00eb premtimi, se kjo \u00e7\u00ebshtje do t\u00eb zgjidhej n\u00eb m\u00ebnyr\u00eb politike. Dhe ne, dua t\u00eb p\u00ebrs\u00ebris k\u00ebt\u00eb fakt, (1) shpreh\u00ebm gatishm\u00ebrin\u00eb ton\u00eb p\u00ebr t\u00eb kontribuuar n\u00eb nd\u00ebrtimin e nj\u00eb qendre moderne kulturore. N\u00eb nj\u00eb deklarat\u00eb t\u00eb K\u00ebshillit Bashkiak t\u00eb qytetit t\u00eb P\u00ebrmetit, m\u00eb 23.12.2005, theksohet se \u201c\u00ebsht\u00eb p\u00ebr t\u2019u p\u00ebrsh\u00ebndetur iniciativa dhe gatishm\u00ebria e Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb dhe e Kryepiskopit Anastas p\u00ebr t\u00eb kontribuar n\u00eb zgjidhjen e k\u00ebtij problemi, duke p\u00ebrshtatur n\u00eb qend\u00ebr kulturore nj\u00eb objekt q\u00eb do t\u00eb plot\u00ebsoj\u00eb kriteret e caktuara\u201d. Ky k\u00ebshill autorizoi kryetarin e Bashkis\u00eb s\u00eb P\u00ebrmetit, z. Petrit Bregasi, p\u00ebr t\u00eb nisur sa m\u00eb shpejt bisedimet dhe t\u00eb marr\u00eb p\u00ebrsip\u00ebr kryerjen e akteve t\u00eb nevojshme p\u00ebr hartimin e nj\u00eb marr\u00ebveshjeje me terma t\u00eb qart\u00eb p\u00ebr zgjidhjen e problemit. (2) N\u00eb Marr\u00ebveshjen midis Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb dhe K\u00ebshillit t\u00eb Ministrave, q\u00eb u b\u00eb ligj i shtetit (nr. 10059\/, 22.1.2009), parashikohet rregullimi politik i k\u00ebsaj \u00e7\u00ebshtjeje. N\u00eb fund fare, n\u00eb periudh\u00ebn tranzitore t\u00eb nd\u00ebrrimit t\u00eb qeverive, u nevojit d\u00ebrgimi i nj\u00eb policie private sigurimi. &nbsp;<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; d) Z. Frash\u00ebri del n\u00eb p\u00ebrfundimin se <em>\u201chir\u00ebsia e tij arrin n\u00eb kulmin e sajes\u00ebs kur pohon se trualli q\u00eb mbulonte Kisha e Sh\u00ebn Maris\u00eb s\u00eb Pazarit s\u00eb bashku me oborrin e saj kapte nj\u00eb sip\u00ebrfaqe prej 6186 m2. \u00cbsht\u00eb e para her\u00eb q\u00eb d\u00ebgjojm\u00eb se kisha e sh\u00ebn Maris\u00eb s\u00eb Pazarit kishte n\u00eb pron\u00ebsi t\u00eb saj 6000 e m\u00eb tep\u00ebr m2. Ne nuk gjejm\u00eb fjal\u00eb se si ta cil\u00ebsojm\u00eb k\u00ebt\u00eb pohim kaq t\u00eb rrem\u00eb\u201d.<\/em> \u00cbsht\u00eb e shum\u00ebfishta her\u00eb, q\u00eb z. Frash\u00ebri na akuzon p\u00ebr gjoja g\u00ebnjeshtra. Por faktet e pap\u00ebrg\u00ebnjeshtrueshme q\u00eb parashtrojm\u00eb gjithmon\u00eb, d\u00ebshmojn\u00eb se kush e p\u00ebrdor g\u00ebnjeshtr\u00ebn. Po botojm\u00eb vendimin zyrtar t\u00eb Gjykat\u00ebs s\u00eb Rrethit Gjirokast\u00ebr, nr. 618\/nr. akt vendimi 461(shih dok. 5). N\u00eb k\u00ebt\u00eb vendim b\u00ebhet fjal\u00eb qart\u00ebsisht se trualli i kish\u00ebs s\u00eb P\u00ebrmetit me sip\u00ebrfaqe totale 6186 m2, iu kthye asaj si truall, por me sip\u00ebrfaqe 4572 m2, duke i hequr pjes\u00ebn tjet\u00ebr, p\u00ebr shkak se n\u00eb t\u00eb ishte nd\u00ebrtuar trotuar dhe lulishte publike.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; \u00cbsht\u00eb e habitshme se si z. Frash\u00ebri p\u00ebrpiqet t\u00eb mbroj\u00eb ata q\u00eb kryen sakrilegjin. Por megjith\u00ebk\u00ebt\u00eb ngjarjet e sakrilegjit kan\u00eb habitur Organizmat Evropian\u00eb fetar\u00eb dhe politik\u00eb. Me nj\u00eb forc\u00eb t\u00eb madhe Asambleja Politike e Partive Popullore Evropiane, n\u00eb nj\u00eb rezolut\u00eb t\u00eb saj\u00ebn nga Brukseli (5.9.2013) thekson: \u201cD\u00ebnojm\u00eb qart\u00ebsisht veprimin ekstremist kund\u00ebr Kish\u00ebs Orthodhokse t\u00eb P\u00ebrmetit, n\u00eb Shqip\u00ebri, ndaj prift\u00ebrinjve t\u00eb saj dhe t\u00eb element\u00ebve pasuror\u00eb, nj\u00eb akt sulmi ekstremist kund\u00ebr krishterimit n\u00eb truallin e Evrop\u00ebs\u201d.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t&nbsp;<\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\"><strong>&nbsp;&nbsp; 3.<\/strong> Z. Frash\u00ebri p\u00ebrpiqet t\u00eb shkas\u00eb nga tema kryesore e debatit dhe t\u00eb devijoj\u00eb n\u00eb \u00e7\u00ebshtje t\u00eb tjera, q\u00eb kan\u00eb pak ose aspak lidhje. N\u00ebse do t\u2019u p\u00ebrgjigjeshim t\u00eb gjithave, do ta lodhnim tej mase lexuesin. Por, megjithat\u00eb, disa pika kan\u00eb nevoj\u00eb p\u00ebr sqarim t\u00eb shkurt\u00ebr. Sa i takon nivelit t\u00eb pamfleteve t\u00eb tij \u00ebsht\u00eb e qart\u00eb se ato p\u00ebrb\u00ebhen nga shum\u00eb fjal\u00eb fyese t\u00eb nj\u00eb niveli fare t\u00eb ul\u00ebt.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; a) Ai rreket t\u00eb krijoj\u00eb dyshime p\u00ebr kontributin ton\u00eb fetar dhe social, me baz\u00eb sjelljen e disa shteteve n\u00eb t\u00eb shkuar\u00ebn, si Italia dhe Jugosllavia, por kjo logjik\u00eb \u00ebsht\u00eb di\u00e7ka krejt\u00ebsisht arbitrare. Vet\u00ebm ai q\u00eb beson n\u00eb Per\u00ebndin\u00eb dhe e do popullin me t\u00eb v\u00ebrtet\u00eb, q\u00ebndron me at\u00eb, duke bashk\u00ebvuajtur p\u00ebr 22 vjet, duke punuar me vet\u00ebsakrifikim p\u00ebr leht\u00ebsimin e atyre q\u00eb kan\u00eb nevoj\u00eb dhe p\u00ebr lart\u00ebsimin shpirt\u00ebror t\u00eb shoq\u00ebris\u00eb, duke nd\u00ebrtuar kisha, klinika, shkolla etj., q\u00eb mb\u00ebshtesin qytet\u00ebrimin.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; b) N\u00eb nj\u00eb vend tjet\u00ebr mb\u00ebshtet tez\u00ebn se mendojm\u00eb, q\u00eb vet\u00ebm klerik\u00ebt mund t\u00eb japin mendime p\u00ebr \u00e7\u00ebshtje theologjike, t\u00eb s\u00eb drejt\u00ebs kanonike dhe t\u00eb historis\u00eb kishtare. \u00cbsht\u00eb m\u00eb se e qart\u00eb se ne nuk mb\u00ebshtesim di\u00e7ka t\u00eb till\u00eb. N\u00eb Kish\u00ebn Orthodhokse, por edhe jasht\u00eb saj ekzistojn\u00eb theolog\u00eb t\u00eb shquar specialist\u00eb n\u00eb \u00e7\u00ebshtje kishtare, t\u00eb cil\u00ebt jan\u00eb laik\u00eb. Frash\u00ebri i ka ngelur besnik teorive t\u00eb vjetra materialiste, q\u00eb i ka mb\u00ebshtetur p\u00ebr dhjet\u00ebvje\u00e7ar\u00eb dhe vendimeve t\u00eb nomenklatur\u00ebs ateiste p\u00ebr t\u00eb luftuar deri n\u00eb fund ideologjin\u00eb fetare dhe p\u00ebr ta zhdukur at\u00eb nga Shqip\u00ebria. Respektojm\u00eb zgjedhjet e tij teorike e n\u00eb p\u00ebrgjith\u00ebsi pik\u00ebpamjet e atyre q\u00eb nuk besojn\u00eb. Besojm\u00eb n\u00eb lirin\u00eb e nd\u00ebrgjegjes. Por, sigurisht, nuk pranojm\u00eb leksione t\u00eb s\u00eb Drejt\u00ebs Kanonike dhe t\u00eb Deontologjis\u00eb kishtare nga persona q\u00eb nuk kan\u00eb kurrfar\u00eb lidhje me k\u00ebt\u00eb fush\u00eb. N\u00eb Shqip\u00ebri u d\u00ebrgua nj\u00eb let\u00ebr Patriarkale dhe Sinodike p\u00ebr klerin dhe popullin e Shqip\u00ebris\u00eb (shih dok. 8, korrik 1992, e cila jepet n\u00eb origjinal dhe e p\u00ebrkthyer). U botua p\u00ebr her\u00eb t\u00eb par\u00eb, e p\u00ebrkthyer n\u00eb Gazet\u00ebn \u201cNgjallja\u201d 1992) Nj\u00eb let\u00ebr e ngjashme \u00ebsht\u00eb d\u00ebrguar nga Patriarkana Ekumenike, m\u00eb 12 qershor 1937, pas shpalljes s\u00eb Autoqefalis\u00eb. Frash\u00ebri nuk ka njohuri p\u00ebr nj\u00eb tekst t\u00eb qart\u00eb, si\u00e7 \u00ebsht\u00eb Kushtetuta e vendit t\u00eb tij, \u00e7dokush e kupton se sa mosnjohje, akoma edhe m\u00eb t\u00eb madhe, ka p\u00ebr t\u00eb Drejt\u00ebn Kanonike t\u00eb Kish\u00ebs, q\u00eb \u00ebsht\u00eb di\u00e7ka m\u00eb komplekse dhe q\u00eb \u00ebsht\u00eb krijuar n\u00eb vende t\u00eb ndryshme, n\u00eb vazhd\u00ebn e shum\u00eb shekujve.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Z. Frash\u00ebri me stil populist shtremb\u00ebron t\u00eb v\u00ebrtet\u00ebn dhe nj\u00eb her\u00eb tjet\u00ebr duke shkruar: \u201c<em>Ju lutem, miq t\u00eb dashur, shikoni p\u00ebrs\u00ebri hilen\u00eb e kryepiskopit. P\u00ebr t\u00eb pasur provat e plota t\u00eb tezave tona, jam i detyruar t\u00eb parashtroj p\u00ebr her\u00eb t\u00eb fundit faktet, disi n\u00eb m\u00ebnyr\u00eb m\u00eb t\u00eb zgjeruar, duke i shoq\u00ebruar me disa dokumente t\u00eb nj\u00eb r\u00ebnd\u00ebsie themeltare,&nbsp; p\u00ebr hir t\u00eb lexuesve objektiv\u00eb t\u00eb gazet\u00ebs. Shum\u00eb nga k\u00ebto i kemi trajtuar tashm\u00eb n\u00eb p\u00ebrgjigjet tona (shih <em>Gazeta Shqiptare<\/em> 31.10.2010 dhe 5.12.2010), por z. Frash\u00ebri i anashkalon dhe rip\u00ebrtyp n\u00eb m\u00ebnyr\u00eb fragmentare versionet e tij t\u00eb pabazuara, duke u p\u00ebrpjekur t\u00eb shkruaj\u00eb historin\u00eb e Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb me m\u00ebnyr\u00ebn e vet.&nbsp;<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Kur pranova p\u00ebrgjegj\u00ebsin\u00eb e ringritjes s\u00eb Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb, krejt\u00ebsisht t\u00eb shp\u00ebrb\u00ebr\u00eb, isha tashm\u00eb mitropolit, profesor i historis\u00eb s\u00eb feve n\u00eb Universitetin e Athin\u00ebs (me studime pasuniversitare n\u00eb Fetarologji n\u00eb Hamburg dhe Marburg t\u00eb Gjermanis\u00eb). Nj\u00ebkoh\u00ebsisht, isha zgjedhur n\u00eb poste t\u00eb r\u00ebnd\u00ebsishme t\u00eb organizmave mbar\u00ebbot\u00ebror\u00eb fetar\u00eb. Si ekzark patriarkal udh\u00ebtova p\u00ebr nj\u00eb vit pothuajse n\u00eb mbar\u00eb Shqip\u00ebrin\u00eb dhe konstatova&nbsp; shp\u00ebrb\u00ebrjen e plot\u00eb t\u00eb Kish\u00ebs Orthodhokse. Sigurisht, q\u00eb nuk kishte asnj\u00eb fron kryepiskopal p\u00ebr t\u2019u ngjitur, por ishte vet\u00ebm nj\u00eb stol i thyer plot me gozhda, q\u00eb kishte l\u00ebn\u00eb persekutimi ateist. Si ekzark Patriarkal u p\u00ebrpoqa t\u00eb k\u00ebrkoj persona t\u00eb p\u00ebrshtatsh\u00ebm me shtet\u00ebsi shqiptare, p\u00ebr t\u2019u dor\u00ebzuar kryepiskop. Por, p\u00ebr fat t\u00eb keq, kjo rezultoi se ishte e pamundur. T\u00eb gjith\u00eb dhe t\u00eb gjitha faktet m\u00ebshonin n\u00eb nj\u00eb mendje, se rim\u00ebk\u00ebmbja e Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb, mb\u00ebshtetur n\u00eb kapacitetet e saj t\u00eb brendshme, ishte di\u00e7ka e paarritshme. Po b\u00ebhesha gati p\u00ebr t\u2019u kthyer n\u00eb detyrat e mia universitare, si edhe n\u00eb kandidatur\u00ebn time p\u00ebr Akademin\u00eb e Athin\u00ebs, kur mij\u00ebra besimtar\u00eb, pavar\u00ebsisht origjin\u00ebs s\u00eb tyre, m\u00eb lut\u00ebn t\u00eb q\u00ebndroja n\u00eb Shqip\u00ebri dhe t\u00eb merrja p\u00ebrsip\u00ebr vepr\u00ebn e ringritjes s\u00eb Kish\u00ebs, q\u00eb vazhdonte t\u00eb ndodhej n\u00eb gjendje t\u00eb pezullt. P\u00ebr her\u00eb t\u00eb par\u00eb pas persekutimit, nj\u00eb p\u00ebrfaq\u00ebsi e Kish\u00ebs s\u00eb Shqip\u00ebris\u00eb vizitoi Patriarkan\u00ebn Ekumenike (5-8.6.1992) dhe k\u00ebrkoi zgjedhjen e Ekzarkut Patriarkal si primat t\u00eb k\u00ebsaj Kishe.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; M\u00eb 24.6.1992, Sinodi i Shenjt\u00eb i Patriarkan\u00ebs Ekumenike m\u00eb zgjodhi me vot\u00eb unanime Kryepiskop i Tiran\u00ebs dhe i Gjith\u00eb Shqip\u00ebris\u00eb (Shih fotokopjen dhe p\u00ebrkthimin e praktikave t\u00eb zgjedhjes nga Kodiku zyrtar i Patriarkan\u00ebs Ekumenike, shih dok. 7). Kur Kisha Orthodhokse Autoqefale e Shqip\u00ebris\u00eb ishte shp\u00ebrb\u00ebr\u00eb plot\u00ebsisht p\u00ebr 23 vjet, autoriteti i vet\u00ebm kishtar q\u00eb kishte kompetenc\u00ebn p\u00ebr t\u00eb marr\u00eb iniciativ\u00ebn p\u00ebr ringritjen e saj, ishte Patriarkana Ekumenike e Konstandinopoj\u00ebs. P\u00ebr arsye se ishte kjo Patriarkan\u00eb q\u00eb i kishte dh\u00ebn\u00eb Autoqefalin\u00eb n\u00eb vitin 1937 dhe q\u00eb nga ana tjet\u00ebr ishte p\u00ebrgjegj\u00ebse p\u00ebr Kishat Orthodhokse t\u00eb ndodhura n\u00eb rrethana t\u00eb v\u00ebshtira &#8211; si\u00e7 kjo njihet n\u00eb m\u00ebnyr\u00eb t\u00eb pand\u00ebrprer\u00eb nga e t\u00ebr\u00eb bota orthodhokse.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Gjat\u00eb periudh\u00ebs tranzitore 1991-92, asnj\u00eb statut tjet\u00ebr i vjet\u00ebr i Kish\u00ebs s\u00eb Shqip\u00ebris\u00eb nuk kishte fuqi kanonike (do ta shpjegojm\u00eb n\u00eb vijim). T\u00eb vetmet dokumente q\u00eb ruanin fuqin\u00eb e tyre kanonike ishin Tomosi Patriarkal dhe Sinodik mbi Autoqefalin\u00eb dhe Tradita e Shenjt\u00eb e Kish\u00ebs. N\u00eb baz\u00eb t\u00eb k\u00ebtyre, u ringrit Kisha Orthodhokse Autoqefale e Shqip\u00ebris\u00eb n\u00eb themele kishtare t\u00eb padiskutueshme dhe p\u00ebr k\u00ebt\u00eb arsye njihet nga t\u00eb gjitha Kishat Orthodhokse, nga t\u00eb gjitha shkollat orthodhokse theologjike dhe n\u00eb p\u00ebrgjith\u00ebsi nga bota e krishter\u00eb.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Zgjedhja e Kryepiskopit, q\u00eb u b\u00eb m\u00eb 24 qershor t\u00eb vitit 1992, ishte sipas akteve n\u00eb fuqi t\u00eb Orthodhoksis\u00eb, nj\u00eb fakt i kryer kishtar. Ky akt iu b\u00eb i ditur me Letra zyrtare Patriarkale t\u00eb gjitha Kishave Orthodhokse Autoqefale, p\u00ebr t\u00eb p\u00ebrfshir\u00eb n\u00eb diptik\u00ebt e tyre, pas 40 vjet\u00ebsh mungese, emrin e Kish\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe emrin e Primatit t\u00eb saj, i cili po merrte p\u00ebrsip\u00ebr ringritjen e saj nga g\u00ebrmadhat. Duhet t\u00eb rikujtojm\u00eb k\u00ebtu, se Sinodi i par\u00eb kanonik i Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb u zgjodh, n\u00eb prill t\u00eb vitit 1937, n\u00eb Konstandinopoj\u00eb, nga Patriarkana Ekumenike, pa pjes\u00ebmarrjen m\u00eb t\u00eb vog\u00ebl t\u00eb faktor\u00ebve t\u00eb tjer\u00eb.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; c) Fron\u00ebzimi i Kryepiskopit u krye, pas nj\u00eb s\u00ebr\u00eb negociatash me autoritetet shqiptare kompetente, n\u00eb Kish\u00ebn Katedrale t\u00eb Ungjill\u00ebzimit t\u00eb Tiran\u00ebs, m\u00eb 2 gusht 1992, n\u00eb prani t\u00eb t\u00eb gjith\u00eb klerik\u00ebve, si dhe t\u00eb laik\u00ebve nga t\u00eb gjitha dioqezat. Liturgjia Hyjnore, si edhe ceremonia e thjesht\u00eb e fron\u00ebzimit u kryen sipas rregullave. Gjat\u00eb Liturgjis\u00eb Hyjnore, m\u00eb 2 gusht 1992, kreu i P\u00ebrfaq\u00ebsis\u00eb Patriarkale, Mitropoliti i Pergjit, z. Evangjelos, lexoi letr\u00ebn&nbsp; Patriarkale dhe Sinodike (nr. prot. 936, 16 korrik 1992), \u201c<em>Drejtuar Klerit dhe popullit t\u00eb Kish\u00ebs Orthodhokse t\u00eb Shqip\u00ebris\u00eb\u201d<\/em> (nr. prot. 936, 16 korrik 1992, shih dok. 8).<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; N\u00eb fund t\u00eb Sh\u00ebrbes\u00ebs, n\u00eb Kish\u00ebn Katedrale, nj\u00eb grup i vog\u00ebl njer\u00ebzish pa lidhje me Orthodhoksin\u00eb, n\u00ebn drejtimin e dy deputet\u00ebve q\u00eb u p\u00ebrkisnin feve t\u00eb tjera, u fut me forc\u00eb n\u00eb kish\u00eb duke k\u00ebnduar k\u00ebng\u00eb patriotike dhe duke thirrur \u201c i padenj\u00eb\u201d. Teoria e disa njer\u00ebzve q\u00eb s\u2019kan\u00eb njohurit\u00eb e duhura, se gjoja fron\u00ebzimi dhe zgjedhja e kryepiskopit u shfuqizuan automatikisht, meq\u00eb u d\u00ebgjuan k\u00ebta z\u00ebra, nga ana e s\u00eb Drejt\u00ebs Kanonike \u00ebsht\u00eb krejt\u00ebsisht arbitrare dhe e pabazuar. Z\u00ebra t\u00eb till\u00eb nuk p\u00ebrb\u00ebjn\u00eb akt pavlefshm\u00ebrie. T\u00eb tjer\u00eb ngat\u00ebrrojn\u00eb aktin midis zgjedhjes dhe fron\u00ebzimit. Zgjedhja ishte kryer n\u00eb Patriarkan\u00ebn Ekumenike n\u00eb qershor t\u00eb vitit 1992, me n\u00ebnshkrimin e t\u00eb gjitha praktikave n\u00eb lidhje me k\u00ebt\u00eb akt nga an\u00ebtar\u00ebt e Sinodit t\u00eb Shenjt\u00eb dhe fron\u00ebzimi ishte pasoja, ishte ceremonia e marrjes p\u00ebrsip\u00ebr t\u00eb detyrave kryepiskopale.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; M\u00eb pas vijoi dreka zyrtare e rastit n\u00eb \u201cHotel Tirana International\u201d, ku nuk u b\u00eb absolutisht asnj\u00eb akt kishtar. P\u00ebr k\u00ebt\u00eb ngjarje jan\u00eb botuar n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrs\u00ebritur d\u00ebshmit\u00eb e pjes\u00ebmarr\u00ebsve. E t\u00ebr\u00eb procedura e vendosjes dhe e pranimit t\u00eb nj\u00eb Primati Orthodhoks b\u00ebhet zyrtare me regjistrimin e tij n\u00eb Diptik\u00ebt e Kishave Orthodhokse dhe me p\u00ebrmendjen e emrit t\u00eb tij nga pjesa tjet\u00ebr e Primat\u00ebve, sa her\u00eb q\u00eb k\u00ebta t\u00eb fundit meshojn\u00eb. Kjo gj\u00eb zuri fill nga dita e zgjedhjes s\u00eb tij, n\u00eb qershor 1992, n\u00eb mbar\u00eb bot\u00ebn orthodhokse. Vendosja e nj\u00eb Primati t\u00eb Kish\u00ebs Lokale b\u00ebhet p\u00ebrfundimtare nga ana ligjore-kanonike me Letrat Paq\u00ebsore, t\u00eb cilat ai ua d\u00ebrgon Primat\u00ebve t\u00eb Kishave t\u00eb tjera Autoqefale dhe me p\u00ebrgjigjet respektive zyrtare q\u00eb ai merr nga ata. T\u00eb gjitha k\u00ebto procedura u kryen n\u00eb m\u00ebnyr\u00eb kanonike. Zgjedhja u p\u00ebrfundua me njohjen e thirrjes s\u00eb Kryepiskopit t\u00eb Shqip\u00ebris\u00eb si \u201cFortlumturi\u201d, si\u00e7 b\u00ebhet me patriark\u00ebt brenda fronit ekumenik dhe kryetar\u00ebt e kishave autoqefale (nr. Prot. 1092\/24 qershor 1992, shih dok. 9). Kisha Orthodhokse si t\u00ebr\u00ebsi dhe jo si nj\u00eb shoqat\u00eb ka histori dhe institucione shum\u00ebshekullore, t\u00eb cilat ruhen me sakt\u00ebsi absolute. G\u00ebzimin dhe k\u00ebnaq\u00ebsin\u00eb e tyre p\u00ebr zhvillimin e Kish\u00ebs e shpreh\u00ebn edhe drejtuesit e Kryepiskopat\u00ebs Shqiptare t\u00eb Amerik\u00ebs (at\u00eb Arthur Liolin dhe Kryepiskopi Nikon Liolin). Ky i fundit erdhi personalisht n\u00eb nj\u00ebzetvjetorin e zgjedhjes s\u00eb Kryepiskopit dhe shprehu vler\u00ebsimin e madh p\u00ebr kontributin e tij t\u00eb jasht\u00ebzakonsh\u00ebm kishtar. Si p\u00ebrfundim, besimi i dh\u00ebn\u00eb me t\u00ebr\u00eb shpirtin dhe p\u00ebrkushtimi i pand\u00ebrprer\u00eb i besimtar\u00ebve orthodhoks\u00eb t\u00eb t\u00eb gjitha krahinave t\u00eb Shqip\u00ebris\u00eb p\u00ebr Kryepiskopin, zhvleft\u00ebsoi \u00e7do lloj p\u00ebrpjekjeje minuese kund\u00ebr tij gjat\u00eb gjith\u00eb k\u00ebtyre nj\u00ebzet e nj\u00eb viteve.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; d) N\u00eb lidhje me Statutin. Disa q\u00eb nuk kan\u00eb njohurit\u00eb p\u00ebrkat\u00ebse dhe pa kurrfar\u00eb lidhjeje me \u00e7\u00ebshtjet kishtare, dalin n\u00eb p\u00ebrfundimin se gjat\u00eb ringritjes s\u00eb Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb, u dhunua Statuti i vitit 1929. Kisha e Shqip\u00ebris\u00eb pati n\u00eb t\u00eb shkuar\u00ebn dy statute: m\u00eb i vjetri, ai i vitit 1929 dhe m\u00eb i riu, u hartua n\u00eb vitin 1950. I fundit u b\u00eb ligj i shtetit, duke e shfuqizuar statutin e m\u00ebparsh\u00ebm t\u00eb Kish\u00ebs (me dekretin 1065, t\u00eb 4 majit 1950). Por edhe ky dekret u shfuqizua me daljen e dekretit 43\/37, t\u00eb 11 n\u00ebntorit 1967. Disavantazhi kryesor i t\u00eb dy k\u00ebtyre statuteve, ishte se ata u krijuan dhe u imponuan nga regjime politike, q\u00eb nuk kishin kurrfar\u00eb lidhje me Kish\u00ebn Orthodhokse, m\u00eb s\u00eb shumti ishin armiq\u00ebsor\u00eb ndaj saj dhe se sanksiononin var\u00ebsi t\u00eb Kish\u00ebs nga pushteti shtet\u00ebror. I pari u hartua n\u00eb vitin 1929, kur Shqip\u00ebria ishte monarki dhe i dyti, n\u00eb vitin 1950, kur n\u00eb vend ishte imponuar pushteti ateist dhe partia-shtet donte t\u00eb ushtronte kontroll t\u00eb plot\u00eb mbi Kish\u00ebn. T\u00eb dy k\u00ebta statute nuk mor\u00ebn parasysh parimet kishtare baz\u00eb.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Statuti i vitit 1929 nuk ishte i vlefsh\u00ebm nga ana kishtare, nuk ishte n\u00eb fuqi, sepse at\u00ebher\u00eb, Kish\u00ebs s\u00eb Shqip\u00ebris\u00eb nuk i ishte dh\u00ebn\u00eb ende asnj\u00eb \u201cautoqefali\u201d. P\u00ebr k\u00ebt\u00eb arsye nuk p\u00ebrmendet n\u00eb asnj\u00eb vend ky Statut i vitit 1929 n\u00eb Tomosin Patriarkal dhe Sinodik q\u00eb doli n\u00eb vitin 1937 dhe q\u00eb p\u00ebrb\u00ebn gurin e themelit t\u00eb padiskutuesh\u00ebm t\u00eb Autoqefalis\u00eb. Teksti i vitit 1929 me nj\u00eb s\u00ebr\u00eb nenesh, vendos n\u00ebn kontrollin absolut t\u00eb mbretit, i cili ishte i nj\u00eb feje tjet\u00ebr, dhe t\u00eb qeveris\u00eb s\u00eb tij, zgjedhjen e udh\u00ebheqjes s\u00eb Kish\u00ebs, por edhe vet\u00eb funksionimin si Kish\u00eb Orthodhokse. Dymb\u00ebdhjet\u00eb nene t\u00eb tij p\u00ebrcaktuan n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb var\u00ebsin\u00eb e Kish\u00ebs nga \u00e7do udh\u00ebheq\u00ebs politik i koh\u00ebs dhe nga strukturat e pushtetit politik. K\u00ebto arsye, qart\u00ebsojn\u00eb dhe theksojn\u00eb se ringritja e Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb, me baz\u00eb Statutin e vitit 1929, do t\u00eb thoshte shkat\u00ebrrim i plot\u00eb i saj, p\u00ebrpara se t\u00eb b\u00ebhej \u00e7do p\u00ebrpjekje p\u00ebr ringritjen e saj (di\u00e7ka q\u00eb sigurisht do ta d\u00ebshironin fort persekutuesit e Kish\u00ebs).<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Kushtetuta e re e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, q\u00eb u votua n\u00eb vitin 1998, p\u00ebrcaktoi karakterin \u201claik\u201d t\u00eb shtetit dhe me dy nene t\u00eb saj (neni 10 dhe 24) sanksionoi plot\u00ebsisht lirin\u00eb fetare dhe pavar\u00ebsin\u00eb e komuniteteve fetare. Pas miratimit t\u00eb Kushtetut\u00ebs s\u00eb re nisi puna p\u00ebr hartimin e Projekt-statutit t\u00eb Kish\u00ebs son\u00eb. E p\u00ebrs\u00ebrisim: Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb e vitit 1998, nuk thot\u00eb absolutisht asgj\u00eb p\u00ebr ratifikimin e zgjedhjes s\u00eb Kryepiskopit nga Presidenti i Republik\u00ebs, si\u00e7 z. Frash\u00ebri ngul k\u00ebmb\u00eb. P\u00ebrkundrazi, n\u00eb nenin 10\/5, thot\u00eb: \u201c<em>Marr\u00ebdh\u00ebniet nd\u00ebrmjet shtetit dhe bashk\u00ebsive fetare rregullohen mbi baz\u00ebn e marr\u00ebveshjeve t\u00eb lidhura nd\u00ebrmjet p\u00ebrfaq\u00ebsuesve t\u00eb tyre dhe K\u00ebshillit t\u00eb Ministrave.&nbsp;K\u00ebto marr\u00ebveshje ratifikohen n\u00eb Kuvend\u201d.<\/em> T\u00eb gjitha k\u00ebto u b\u00ebn\u00eb sipas rregullit dhe Marr\u00ebveshja pas ratifikimit t\u00eb Kuvendit, u dekretua nga Presidenti i Republik\u00ebs z. Bamir Topi dhe u b\u00eb Ligj i Shtetit (nr.10057\/22.1.2009, Fletorja Zyrtare nr.7, 4 shkurt 2009, fq. 138-146). Pas depozitimit t\u00eb dokumenteve t\u00eb parashikuara me ligj, Gjykata e Tiran\u00ebs njohu edhe ligj\u00ebrisht Kish\u00ebn Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb si person juridik, t\u00eb administruar dhe t\u00eb rregulluar prej Statutit t\u00eb ri. T\u00eb gjitha k\u00ebto tekste zyrtare njohin si p\u00ebrfaq\u00ebsues t\u00eb ligjsh\u00ebm t\u00eb Kish\u00ebs Orthodhokse Autoqefale t\u00eb Shqip\u00ebris\u00eb, Kryepiskopin e Tiran\u00ebs, Durr\u00ebsit dhe Gjith\u00eb Shqip\u00ebris\u00eb, Anastasin dhe kan\u00eb firm\u00ebn e tij.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Z. Frash\u00ebri dhe sa mendojn\u00eb si ai, n\u00eb m\u00ebnyr\u00eb monotone dhe fragmentare rip\u00ebrtypin rr\u00ebfimet e tyre. Sigurisht, nuk b\u00ebhet fjal\u00eb q\u00eb t\u00eb ndryshojn\u00eb, sepse pik\u00ebpamjet e tyre mb\u00ebshteten n\u00eb d\u00ebshirat e tyre dhe jo n\u00eb sakt\u00ebsin\u00eb historike. Por \u00ebsht\u00eb i mjaftuesh\u00ebm fakti se shum\u00eb njer\u00ebz q\u00eb kan\u00eb dijeni dhe theolog\u00eb kompetent\u00eb orthodhoks\u00eb e episkop\u00eb orthodhoks\u00eb n\u00eb mbar\u00eb bot\u00ebn, si edhe t\u00eb kishave t\u00eb tjera, e njohin t\u00eb v\u00ebrtet\u00ebn dhe pranojn\u00eb vlefshm\u00ebrin\u00eb e t\u00eb gjithave sa kan\u00eb ndodhur. Mbi t\u00eb gjitha, k\u00ebt\u00eb t\u00eb v\u00ebrtet\u00eb e njohin qindra mij\u00eb orthodhoks\u00eb q\u00eb e rrethojn\u00eb n\u00eb nj\u00ebzet e nj\u00eb vjet Kryepiskopin e tyre me p\u00ebrkushtimin, mir\u00ebnjohjen dhe dashurin\u00eb e tyre.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t&nbsp;<\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\"><strong>&nbsp;&nbsp; 5. <\/strong>Duke e p\u00ebrfunduar, le t\u2019i rikthehemi tem\u00ebs s\u00eb rivendikimit nga Kisha Orthodhokse e Shqip\u00ebris\u00eb t\u00eb vendeve t\u00eb shenjta t\u00eb kultit, me shkak ngjarjet e P\u00ebrmetit, q\u00eb sh\u00ebrbyen si pik\u00ebnisje p\u00ebr kund\u00ebrv\u00ebnien e fundit.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n\t<span style=\"color:#000000;\"><span style=\"font-size: 12px;\"><span style=\"font-family: verdana,geneva,sans-serif; line-height: 1.5;\">&nbsp;&nbsp; Sivjet kremtohet mbar\u00ebbot\u00ebrisht 1700-vjetori i Ediktit t\u00eb Milanos, q\u00eb nxor\u00ebn bashk\u00ebperandor\u00ebt Konstandin dhe Licinius. B\u00ebhet fjal\u00eb p\u00ebr nj\u00eb nga tekstet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb historis\u00eb bot\u00ebrore t\u00eb politik\u00ebs dhe t\u00eb fes\u00eb, q\u00eb p\u00ebrcaktoi fundin e persekutimeve kund\u00ebr t\u00eb krishter\u00ebve n\u00eb Perandorin\u00eb Romake dhe vendosi toleranc\u00ebn fetare. Theksi q\u00eb i jepet k\u00ebtij fakti \u00ebsht\u00eb mbres\u00ebl\u00ebn\u00ebs.
